Terms & Conditions

1. General

Notwithstanding anything to the contrary these Terms and Conditions contain the only terms upon which Neither party shall be liable for delay in or failure to perform its obligations under these Terms and Conditions if such delay or failure results from circumstances beyond its reasonable control. CPACLTS will provide Services via a 30 day credit account and shall not be varied unless expressly agreed in writing, signed by the owner of CPACLTS. These terms and conditions should be read in conjunction with the general terms and conditions displayed on the website www.cpaclts.co.uk. All accounts, both business and personal are subject to status. By applying for an account you authorise us to complete any necessary checks. We do not supply to addresses outside of the UK other than by specific agreement.

2. Cancellation

The customer may cancel their credit account at any time by emailing Customer Services at bookings@cpaclts.co.uk  Individual journeys may be cancelled upto 24hours prior to commencement by telephoning or emailing our customer service, after this time 25% of the planned journey cost will still be billed. We reserve the right to cancel any credit account without notice.

3. Terms of Payment

The Customer shall pay within 30 days of the date of the invoice. Invoices paid after 30 days but before 45 days will be subject to 15% late payment fee. Invoices paid from 45 days but before 60 days will be subject to 25% late payment fee on top of the 15% fee previously charged. Any payments not received within 60 days will be subject to a 250% late payment fee on the entire balance including all previous late payment fees. A court claim fee plus administration charges will be added to this calculation. Payments can be made by credit/debit card (preferred method) online, BACS, cheque, or via cash as arranged with customer services at cpaclts.co.uk Should you prefer to pay upfront directly online by credit/debit card you will not qualify for 30 day terms. You will however receive whatever credit terms are available from your card provider. Online payments by credit card are not subject to a credit limit. If a customer’s account exceeds the credit limit or has outstanding payments against it then no further vehicles will be dispatched until the account is returned to credit.

4. Discounts

From time to time we may offer discounts to account customers based on a qualifying spend level over a period of time. Where a discount is made available then the discount period and amount will be agreed and we accept no obligation to continue the discount beyond the agreed period. We are not obliged to offer discounts and normally these will only apply to existing customers who commit to an annual volume of usage.

4A. Indicative Price Display

Where product prices are shown exclusive of applicable taxes (and the price may also have a discount incorporated), product prices shown are indicative based on the calculation of the removal from the normal gross price of the discount and then any taxes to present you with an indicative price excluding any taxes that you will pay. Due to the nature of the rounding this may mean that the presentation of the ‘price each’, will only be accurate to two decimal places and therefore is only indicative at all times. The total price you will pay for the order is shown at the basket.

5. Satisfaction

All Services supplied by CPACLTS are subject to our Satisfaction Promises. In the event that you are unhappy with any of the services provided to you, please contact our customer service at the earliest opportunity.

6. How to Book your Vehicle

The quickest way to book your vehicle and speed up dispatch is to book online using the website www.cpaclts.co.uk, and select cash payment, letting us know in special requirements if you wish to place your booking on account. We also accept orders by email to bookings@cpaclts.co.uk and by telephone on 07447441301 or 07455285519. Our hours of contact are 8:00am to 8:00pm Monday to Saturday and 10:00am to 4:00pm Sunday. Outside these hours we may be working and answering calls but are not obligated to.

The Contract Between Us

 

  1. Any contract for bookings made through the website or any other method of contact will be with CPACLTS, 17 Ashton Drive, Lancaster, LA1 2LQ, United Kingdom
  2. When you place an order on our website to book journeys with us, that constitutes an “Offer to Buy” from you. We accept this booking when we send you an “Order Confirmation” email confirming that we have received & accepted the booking you have sent to us. That acceptance will be deemed to be complete and communicated to you at the time we send the Confirmation email, whether you receive that email or not. The confirmation email will include your name, the order number and the total price. cpac.co’s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
  3. For clients paying on account – the contract (as stated in (b) above) will be formed upon communication confirming that we have accepted the booking you have made with us.
  4. cpac.co are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the services appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered before the contract is made (see (b) above) we will contact you as soon as possible by email.
  5. The website is updated multiple times a day with regard to Service Availability. Whilst every effort is made to show the correct availability of services; the service availability shown on the web site is an indication of the availability at the time of the last update and does not constitute confirmation of service availability at the time of order. cpac.co are entitled to withdraw from any contract that cannot be fulfilled due to lack of vehicles. If a service availability issue is discovered with regard to the journey(s) that you have booked before the contract is due to take place we reserve the right to subcontract the work out to other appropriate service providers and will contact you as soon as possible by email, voice or text to inform you who is carrying out the contracted work on behalf of cpac.co.

7. Customer Service

Our Customer Service team are available Monday to Saturday between 8:00am and 8:00pm, 10:00am and 4:00pm Sunday. We endeavour to respond to all queries the same day and certainly within 24 hours.

8. Refunds

In the unlikely event that services provided have been charged incorrectly we will rectify this without delay. If a credit account has been charged too much for bookings a credit will be issued and shows on your next statement. Should a credit account be charged too little for a job, and not an error in any quotation which we offer as a legally binding price, we reserve the right to put the price difference on your next statement and will contact you to explain our reasons for this.

9. Force Majeure

Neither party shall be liable for delay in or failure to perform its obligations under these Terms and Conditions if such delay or failure results from circumstances beyond its reasonable control.

10. Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with UK Law, and the parties hereby submit to the non-exclusive jurisdiction of the UK Courts.

These terms and conditions, together with the current cpac.co website terms and conditions of purchase, prices, delivery details and cpac.co contact details, set out the whole of our agreement relating to the supply of the services to you by cpac.co. These terms and conditions cannot be varied except in writing signed by the owner of cpac.co. In particular, nothing said by any person on behalf of cpac.co should be understood as a variation of these terms and conditions or as an authorised cpac.co representation about the nature or quality of any services offered for sale by cpac.co. cpac.co shall have no liability for any such representation being untrue or misleading.
